            This article is regarding the grant of FIRST increment after initial appointment, promotion including up-gradation under MACPS.

            In this connection, the following communications may be referred to. 

1.      Rule 10 of CCS(RP) Rules 2016

2.      Govt. of India, Ministry of Finance, Department of Expenditure no F.No.4-21/2017-IC/E.III(A) dated 31.7.2018.

3.      Govt. of India, Ministry of Finance, Department of Expenditure no F.No.4-21/2017-IC/E.III(A) dated 28.11.2019

4.      My earlier article in SAPOST “Grant of first increment after promotion consequent on the orders dated 31.7.2018” posted on 10.9.2018.

The 7th CPC has introduced 2 dates of increment on 1.1 and 1.7 of every year. As per the orders cited 1 above, those officials who were promoted or awarded MACP between 2.1 to 30.6 will draw their first increment after promotion on 1.1 of the next year. Similarly those officials who were promoted or awarded MACP between 2.7 to 31.12 will draw their first increment after promotion on 1.7 of the next year.

Subsequently, clarifications were issued vide 2 above. As per this communication, those officials who were promoted or awarded MACP on 1.1 and 1.7 will draw their first increment after promotion on the subsequent 1.7 or 1.1, as the case may be, on completion of 6 months’ service after their promotion.

I have pointed out in my article cited 4 above, that this benefit of drawing the first increment after 6 months should be extended to those officials also, who are promoted or awarded MACP between 2.1 to 30.6, 2.7 to 31.12 and exercised option for their pay fixation on the DNI. I have also pointed out that if this is not done, there will be anomaly that the juniors will get more pay that the seniors. This had been explained with suitable examples.

As the conclusion, the following was suggested in that article. The exact text is reproduced below for ready reference.

“The order dated 31.7.2018 needs to be modified as follows.

Original order
            As per the communication 2 above, it is clarified that in case an employee is promoted or granted financial up-gradation including up-gradation under the MACP scheme on 1st January or 1stJuly, where the pay is fixed in the level applicable to the post on which promotion is made in accordance with the Rule 13 of the CCS(RP) Rules 2016, the first increment in the level applicable to the post on which promotion is made shall accrue on the following 1st July or 1st January, as the case may be, provided a period of 6 months’ qualifying service is strictly fulfilled. The next increment shall, however, accrue only after completion of one year.
To be modified as
            As per the communication referred 2 above, it is clarified that in case an employee is promoted or granted financial up-gradation including up-gradation under the MACP scheme on 1stJanuary or 1st July and in case of an employee who exercises option for fixation of pay on date of next increment, consequent on promotion or financial upgradation including upgradation under MACP, and where the pay is fixed in the level applicable to the post on which promotion is made in accordance with the Rule 13 of the CCS(RP) Rules 2016, the first increment in the level applicable to the post on which promotion is made shall accrue on the following 1stJuly or 1st January, as the case may be, provided a period of 6 months’ qualifying service is strictly fulfilled. The next increment thereafter, shall, however, accrue only after completion of one year. “

            This has been accepted and orders issued vide 3 above. Clarification has been issued under para 6 against issue no 2; The same is reproduced below.
Issue no 2: Accrual of next increment in case of regular promotion/financial upgradation of an employee on any date other than the date of annual increment and option for pay fixation is exercised under FR 22(I)(a)(1).
Para 6:            The opportunity to exercise of option for pay fixation under FR 22(I)(a)(1) is available to employees in case of promotion/financial up-gradation. Therefore, the Central Government employee promoted on regular basis/granted financial up-gradation on any date other than the date of his/her annual increment in lower grade and exercises the option under FR 22(I)(a)(1) read with Department of Personnel &  Training’s OM no. 13/02/2017-Estt,(Pay-I) dated 27.7.2017 for fixation of pay from the dae of accrual of next increment in the scale of pay in lower grade, he may be allowed the 1st increment in promotional grade on 1st January/1st July as the case may be after completion of 6 months’ qualifying service after such fixation on 1stJuly/1st January (i.e. the date of increment in lower grade) on the analogy of Department of Expenditure’s OM dated 31.7.2018. The next increment, thereafter, shall however accrue only after completion of one year. “
            The requested clarification has now been granted by the department. I thank one and the all who took steps to get this order from the Government. I also thank SAPOST for publishing my article and which made many officials to think and act over this issue.

            I want to put the following important points to our valuable readers.

1.      Another chance is given to re exercise the option on promotion. All the officials who are awarded MACP after 1.1.2016 have their annual increment only on 1.7 every year. Those officials who have got their MACP between 2.1 and 30.6 may have opted to fixation on the date of promotion. In that case, their first increment would have been drawn on 1.1. next year. For example one official who was awarded MACP on 1.3.2017 got his fixation on 1.3.2017 with DNI 1.1.2018. This official should chance his option for fixation on 1.7.2017 now and they will get their next increment on 1.1.2018. Also, some of the officials who was awarded MACP on 1.3.2017 opted for fixation on DNI, 1.7.2017 and in their case, the first increment would have been drawn on 1.7.2018, as per orders dated 31.7.2018 (which was silent in this case). Their increment will be modified as 1.1.2018 now. All such officials are requested to utilize this opportunity to revise their option.    

2.      In the above cases “if the official has even 1 day of non-qualifying service (dies non) between 1.7.17 to 31.12.2017, his next increment will be on 1.7.2018 only.”
